Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you (“User,” “you,” or “your”) and FindMyCourse Ltd, a company registered in England and Wales (Company No. 17325137), registered office Suite 10, Capital House, 61 Amhurst Road, London, E8 1LL, United Kingdom (“FindMyCourse,” “Company,” “we,” “our,” or “us”), governing your access to and use of the FindMyCourse.ai website, mobile applications, AI chatbot, course discovery tools, study abroad advisory services, communication channels, and all related features and content (collectively, the “Platform”).

FindMyCourse Ltd operates the Platform and is the party with which you contract under these Terms. The Platform was developed by, and is provided with technology and operational support from, Urban Educational Consultants Private Limited, a company incorporated under the laws of India and affiliated with FindMyCourse Ltd through common ownership (“our Affiliate”). Our Affiliate contracts with university and course-provider partners in the Indian market; FindMyCourse Ltd contracts with such partners in the United Kingdom, European Union, Ireland, and other markets. FindMyCourse Ltd operates the Platform under a licensing agreement with our Affiliate.

By accessing, browsing, registering for, or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must stop using the Platform.

1. About FindMyCourse.ai

FindMyCourse.ai is an educational discovery and advisory platform that offers, among other things, the following services:

Online Course Discovery

We aggregate publicly available information about online courses offered by third-party providers including, without limitation, Coursera, edX, Udemy, and similar platforms (“Course Providers”), and our AI-powered chatbot may suggest courses to users. We do not deliver, accredit, or grade any course.

On-Campus Course and College Search

We aggregate publicly available information about on-campus courses, programs, and colleges (“Colleges”), and our AI-powered chatbot may assist users in discovering and comparing such offerings. The on-campus search service is informational in nature. We do not deliver, accredit, or grade any course.

Study Abroad Advisory

We surface information about overseas universities, programs, and pathways, and, subject to your explicit opt-in, may introduce users to universities, education partners, and accredited agents (“Education Partners”).

Commercial arrangements

The Platform is made available to users free of charge. We may, from time to time and in our sole discretion, enter into commercial arrangements with Course Providers, Colleges, Education Partners, and other third parties, including arrangements involving referral, affiliate, lead-generation, promotional, advertising, or similar fees. We may also process and use de-identified, aggregated, or anonymised data derived from use of the Platform for our internal and commercial purposes, including disclosure to third parties, in each case in a manner that does not identify any individual user. The existence, nature, and terms of any such arrangements are confidential and proprietary to us, save where disclosure is required by applicable law.

2. Eligibility

By using the Platform, you represent and warrant that:

  • You are at least eighteen (18) years of age, or, if you are below 18, you are using the Platform with the verifiable consent and supervision of a parent or lawful guardian;
  • You have the legal capacity to enter into these Terms;
  • Your use of the Platform complies with all laws and regulations applicable to you;
  • All information you provide is accurate, current, and complete.

If we have reason to believe you do not meet these requirements, we may suspend or terminate your access.

3. Account Registration and Security

Some Platform features require you to create an account. You agree to:

  • Provide accurate registration information and keep it updated;
  • Maintain the confidentiality of your login credentials;
  • Be solely responsible for all activity that takes place under your account;
  • Notify us immediately at [email protected] of any unauthorised access or suspected security breach.

We may suspend or terminate accounts that we reasonably suspect are involved in fraud, abuse, automated access, or other violations of these Terms.

4. Nature of the Services and No-Guarantee Disclaimer

The Platform uses artificial intelligence systems, large language models, recommendation engines, and automated ranking models to generate course suggestions, study abroad insights, and advisory responses. You expressly acknowledge and agree that:

  • Outputs are generated probabilistically and may be incomplete, inaccurate, outdated, biased, or unsuitable for your circumstances;
  • AI responses may not involve human review;
  • The Platform is informational only and is not a substitute for legal, immigration, financial, academic, career, or professional advice;
  • Course Providers, universities, Colleges, immigration authorities, scholarship bodies, lenders, and other third parties retain sole authority over their decisions, including admissions, visas, scholarships, fees, and outcomes;
  • We do not guarantee admissions, visas, scholarships, financial aid, course quality, employability, earnings, migration outcomes, or any other result;
  • You are solely responsible for verifying any information independently before relying on it or acting on it.

5. Third-Party Commercial Arrangements

Certain links, references, listings, rankings, suggestions, and other content surfaced on the Platform may be the subject of commercial arrangements between us and Course Providers, Colleges, Education Partners, or other third parties, including without limitation affiliate, referral, lead-generation, advertising, sponsorship, or featured-placement arrangements. Where applicable law requires disclosure, we will provide it in the manner required by law, which may take the form of a label (such as “Featured,” “Sponsored,” “Promoted,” or similar) or a general disclosure through these Terms, in each case as we determine in our sole discretion. The presence or absence of any specific label does not, by itself, indicate the existence or non-existence of any commercial arrangement, and you should not rely on any such label as a measure of suitability.

Where you opt in to be introduced to an Education Partner, we may share your information with that Education Partner for the purposes of that introduction, and we may receive a fee in connection with such introduction. We will share your information only after a separate, explicit opt-in by you for that specific inquiry, in accordance with our Privacy Policy. You are solely responsible for evaluating any course, College, university, partner, or other third party before acting, and we make no representation or warranty as to the suitability of any of them for your circumstances.

6. Acceptable Use

You agree not to:

  • Scrape, crawl, mine, or harvest Platform content, datasets, or chatbot outputs;
  • Use bots, automated tools, or scripts to access the Platform without our prior written consent;
  • Use Platform content, outputs, prompts, datasets, or workflows to train, fine-tune, evaluate, or benchmark machine-learning or AI models;
  • Reverse-engineer, decompile, replicate, or attempt to derive the source code or underlying models of the Platform;
  • Circumvent security or usage controls;
  • Introduce malware, harmful code, or disruptive technologies;
  • Misrepresent your identity or affiliation, or impersonate any person;
  • Use the Platform for unlawful, fraudulent, defamatory, abusive, harassing, or infringing purposes;
  • Submit content that you do not have the right to submit, or that violates the rights of others;
  • Use the Platform in any manner that breaches applicable data protection laws, the UK GDPR, the Information Technology Act, 2000, or other applicable laws.

7. User Submissions and Content

You retain ownership of any content you submit to the Platform, including chatbot inputs, profile information, and feedback (“User Submissions”). By submitting content, you grant us a worldwide, royalty-free, sub-licensable, and transferable licence to use, store, reproduce, modify, create derivative works of, publish, and display such content for the purposes of operating, improving, and promoting the Platform, training and refining our internal AI models, and producing aggregated and anonymised insights.

You represent that you have all rights necessary to grant the above licence and that your User Submissions do not violate the rights of any third party or any law.

8. Intellectual Property

All Platform content, software, source code, AI systems, model weights and prompts, datasets, branding, trademarks, layouts, text, graphics, interfaces, compilations, and proprietary methodologies are owned by or licensed to FindMyCourse Ltd and are protected under applicable intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform for your own lawful, non-commercial purposes. No other rights are granted, expressly or by implication.

9. Third-Party Services and External Providers

The Platform may integrate with, link to, or reference Course Providers, Education Partners, universities, Colleges, scholarship programs, loan providers, coaching partners, immigration consultants, and other external services. We do not control and are not responsible for:

  • Decisions made by such third parties;
  • The quality, availability, accuracy, or pricing of third-party services;
  • Third-party privacy practices and policies;
  • Educational, financial, or migration outcomes associated with third parties.

Your dealings with third parties are solely between you and the third party.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which forms part of these Terms by reference.

11. No Charges to Users

The Platform is currently made available to users free of charge. Any fees you pay to Course Providers, Education Partners, universities, Colleges, agents, or other third parties are governed by those third parties' terms, and we are not a party to such transactions.

We reserve the right, at any time and in our sole discretion and without prior notice, to introduce paid features, subscriptions, plans, or other charges in respect of all or any part of the Platform, and to modify, vary, or discontinue any free feature. Any paid features will be subject to additional terms, which you must accept before being charged.

12. Disclaimers

To the maximum extent permitted by law:

  • The Platform is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied;
  • We disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted operation;
  • We do not warrant that the Platform will be free from errors, defects, viruses, or interruptions;
  • We do not warrant the accuracy, completeness, or reliability of AI-generated outputs, third-party data, or external information.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

(a) Neither we nor our Affiliate, nor our respective officers, directors, employees, licensors, or partners, shall be liable for any indirect, incidental, consequential, exemplary, special, or punitive damages, including loss of profits, revenue, data, goodwill, opportunity, or reputational harm, however arising and whether in contract, tort (including negligence), or otherwise.

(b) We shall not be liable for missed deadlines, course outcomes, admission rejections, visa denials, scholarship outcomes, third-party acts or omissions, or any reliance on AI-generated outputs.

(c) Our total aggregate liability arising out of or in connection with the Platform and these Terms, from all claims in aggregate, shall not exceed the greater of (i) the total fees actually paid by you to us in the twelve (12) months preceding the event giving rise to the liability, and (ii) one hundred pounds sterling (£100). Because the Platform is provided to users free of charge, you acknowledge that this amount will ordinarily be £100.

(d) If any limitation or exclusion in this Section is held unenforceable in any jurisdiction, it shall be severed and the remaining limitations shall continue to apply, and the unenforceable provision shall be replaced by the most protective limitation permitted by the applicable law of that jurisdiction, giving effect to our intention to limit liability to the greatest extent lawfully possible.

(e) Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any statutory rights of consumers that cannot be waived under the mandatory law applicable to them.

14. Indemnification

You agree to defend, indemnify, and hold harmless FindMyCourse Ltd, our Affiliate, and our respective officers, directors, employees, advisors, licensors, and partners from and against all claims, liabilities, damages, losses, penalties, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your access to or use of the Platform;
  • Your User Submissions;
  • Your breach of these Terms;
  • Your violation of any law or third-party right;
  • Any unlawful, fraudulent, or unauthorised activity in connection with your account.

15. Suspension and Termination

We may suspend, restrict, or terminate your access at any time, with or without notice, where we reasonably believe you have violated these Terms or applicable law, where required for security, legal, or operational reasons, or where we discontinue any feature.

You may stop using the Platform at any time and may request account closure by writing to [email protected].

16. Modifications to the Platform

We are continuously developing and changing the Platform. We reserve the right, at any time and in our sole discretion and without prior notice or liability to you, to add, modify, suspend, withdraw, or discontinue any feature, function, service, content, AI model, recommendation logic, ranking methodology, user interface, or any other aspect of the Platform, in whole or in part, and to impose limits or restrict access. You agree we shall not be liable to you or any third party for any such change.

17. Assignment, Business Transfers, and Successor Operations

You may not assign or transfer your rights or obligations without our prior written consent.

You acknowledge and expressly agree that we may assign, novate, transfer, disclose, or otherwise deal with these Terms, your account, related records, Platform assets, business operations, and associated personal data in connection with:

  • Mergers, acquisitions, share sales, or asset sales (including any transfer of the Platform or its operation between us and our Affiliate);
  • Strategic investments, financing, and joint ventures;
  • Corporate restructuring, internal reorganisations, and affiliate transactions;
  • Insolvency, liquidation, or other proceedings;
  • Due diligence with prospective acquirers, investors, lenders, and their advisors, subject to confidentiality;
  • Successor operations following any of the above.

Successor entities will be required to honour materially equivalent protections in relation to your data and these Terms. Where applicable law requires user notice or fresh consent, we will comply.

Without prejudice to the foregoing, the following constitute Platform assets that may be retained, transferred, assigned, novated, sub-licensed, or otherwise dealt with independently of, or in connection with, any transaction or successor operation described above, and shall survive any such transaction: (a) all User Submissions and the rights and licences granted in respect thereof; (b) all de-identified, aggregated, anonymised, or pseudonymised data, datasets, derivatives, insights, and analytics; (c) all AI models, model weights, parameters, embeddings, prompts, fine-tuning data, training data, and other artefacts derived in whole or in part from User Submissions or Platform usage; and (d) all proprietary methodologies, ranking logic, recommendation algorithms, and related know-how. The licences granted under Sections 7 and 8 continue in favour of any successor, assignee, transferee, or sub-licensee.

18. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, epidemics, war, terrorism, civil unrest, government actions, network or infrastructure failures, power outages, or third-party service disruptions.

19. Reporting Unlawful Content

If you believe any content on the Platform is unlawful, infringing, defamatory, or otherwise violates these Terms or applicable law, please notify us (Section 23) with:

  • A description of the content and its location;
  • The basis on which you believe it is unlawful or infringing;
  • Your name, contact details, and a good-faith statement;
  • Where applicable, proof of ownership of any rights asserted.

We will review valid notices and take appropriate action in accordance with applicable law.

20. Governing Law and Dispute Resolution

These Terms, and any dispute or claim arising out of or in connection with them or the Platform, are governed by the laws of England and Wales, without regard to conflict-of-laws principles, and the courts of England and Wales shall have jurisdiction — except that: (a) where you are a consumer resident in a jurisdiction whose mandatory law grants you the protection of your home courts or law, nothing in these Terms deprives you of those mandatory protections; and (b) in respect of matters concerning our Affiliate or users in the Indian market, the laws of India apply and the courts at Barnala, Punjab, India shall have jurisdiction.

We may, at our discretion, require disputes to be resolved by binding arbitration before a sole arbitrator, seated in London (for matters under England and Wales law) or Barnala, Punjab (for matters under Indian law), conducted in English, save where such arbitration is not permitted against a consumer under mandatory applicable law.

21. Survival

Provisions relating to user submissions, intellectual property, disclaimers, limitation of liability, indemnification, modifications to the Platform, assignment and business transfers, governing law and dispute resolution, and any other provisions that by their nature should survive, will survive termination of these Terms.

22. Severability, Waiver, and Entire Agreement

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

No waiver

Our failure to enforce any provision is not a waiver of our right to enforce it later.

Entire agreement

These Terms, together with the Privacy Policy and any additional feature-specific terms we publish, constitute the entire agreement between you and us regarding the Platform.

We will acknowledge grievances within twenty-four (24) hours and aim to resolve them within fifteen (15) days, in accordance with applicable law.

24. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Platform or by email. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
